Examining Sexual Abuse Claims Under SB 88

The Child Sexual Abuse Accountability Act (SB 88) gives survivors who endured sexual abuse as a child to hold their perpetrators and the organizations that harbored them accountable for their heinous actions. Before the enactment of SB 88, survivors had limited time constraints to file a sexual abuse claim, leaving sexual abuse survivors unable to pursue legal action. Here’s what survivors need to know about SB 88 and how it extended the statute of limitations for childhood sexual abuse claims in Colorado.

When Can Childhood Sexual Abuse Survivors Begin Filing Claims?

Starting on January 1, 2022, survivors can file a claim against their abuser and organizations that covered up abuse decades ago. The law allows sexual abuse claims to be filed under SB 88 if the sexual abuse occurred on or after January 1, 1960, and January 1, 2022. The deadline for filing a childhood sexual abuse claim under the new statute of limitations is January 1, 2025.
