Understanding Time Limits in Sexual Abuse Claims

When filing a civil lawsuit in Colorado or any other state in the country, there are time constraints for which you can do so. While you may be familiar with the term “statute of limitations,” it’s essential to understand how the process works and how much time survivors of sexual abuse have when filing a claim. Learn how childhood sexual abuse survivors can hold their perpetrators and the institutions that harbored them accountable for their heinous actions under Senate Bill 88.

What is Senate Bill 88?

Senate Bill 88, also known as the Childhood Sexual Abuse Accountability Act (SB88), extends the statute of limitations for survivors of childhood sexual abuse. Previous Colorado laws for civil sexual assault claims left many survivors ineligible to file a claim due to time limits on when a claim could be brought.

How to File a Claim Under SB 88

Under SB 88, on January 1, 2022, survivors who were subjected to childhood sexual abuse on or after January 1, 1960, and January 1, 2022, have until January 1, 2025, to file a sexual abuse claim against their perpetrator. Managing organizations that knew or should have known that an actor or youth-related activity or program posed a risk of sexual abuse against a minor can also be held accountable under SB 88. Read on to learn more about how to get support when you are ready to speak out against your abuser and file a civil claim.
