Why File a Claim?
If you reported your assault to the authorities, it’s possible you’ve already seen your abuser put through the criminal justice system. Even if this is the case, you can—and should—file a civil lawsuit against them as well.
While criminal suits seek to hold wrongdoers accountable, the way our system works can make it hard for survivors to prevail. Even if you do, you may receive some closure from seeing an abuser held accountable, but you receive no material benefits.
Civil claims are opposite on both points. For one, civil court has a lower burden of proof. In a criminal case, the prosecution must be able to prove beyond a reasonable doubt that the defendant committed a crime. In a civil case, we only have to prove your claim by a preponderance of the evidence—in other words, by showing it is more than 50% likely your claim is true.
By filing a civil lawsuit, you can also receive compensation to help you recover and move forward. Sexual assault can lead to both physical and mental health struggles. These, in turn, may interfere with your ability to work, participate in social activities, or otherwise live your life as you used to. We can help you request damages not only to cover the expense of receiving the healthcare you need but also to address the emotional harm you suffered as a result of the assault. With this compensation, you may be able to find a new way forward.
What Is The Statute Of Limitations For Filing A Sexual Abuse Claim In Colorado?
The statute of limitations for filing a sexual abuse claim in Colorado varies depending on the circumstances and the age of the victim. For adults, the general statute of limitations is twenty years from the date of the incident. However, if the abuse occurred when the victim was a minor, Colorado law provides more extended timeframes.
For childhood sexual abuse, there is no statute of limitations. The old statute of limitations was that victims had to wait until they turned 24 years old. However, this was repealed on January 1, 2022. It allows survivors of childhood sexual abuse to file claims retroactively, even if the previous statute of limitations had expired.
It's crucial to speak with expert Colorado sexual abuse lawyers from Colorado Sex Abuse Law to learn how these laws relate to your particular situation. You can navigate the legal system with the assistance of a qualified lawyer from our office, who will make sure that your rights are upheld and that your claim is filed in the right time period.

We Handle SB 88 Claims
Helping Child Sexual Abuse Survivors Find Justice
Thanks to Colorado Senate Bill 88, survivors of child sexual abuse who were previously barred from bringing claims are now eligible to file. If you were sexually abused as a child after January 1, 1960, you can file a claim against the individual(s) who harmed you and the organization they were a part of.
Some of the organizations you may be able to sue include:
- YMCA
- Boy Scouts
- Little Leagues
- Clergy/Catholic Church
- Schools
- College campuses
- Businesses
- Doctors
- Therapists
- Gyms
SB 88 only gives a limited three-year window for you to file, and we do not want you to miss your chance. Call us today to start your claim.
Sexual assault and abuse are finally being taken more seriously, which has led to new legislative efforts to help survivors find justice. However, you may have questions—about the limitations of SB 73 or SB 88, about how the Boy Scouts of America’s bankruptcy may affect your claim, or other vital questions. Our team stays on top of the law, even following legislation under consideration. After hearing your story, we can let you know exactly what laws apply to your claim. If you have any questions, we invite you to ask one of our experienced attorneys. We treat all communications with discretion and confidentiality.
